What Information We Collect

  • Personal Information: We collect information you provide directly, such as your name, email address, and billing information.
  • Usage Data: Our web server keeps ordinary access logs for security and troubleshooting, which can include an IP address and a browser type. We do not attach an IP address to your newsletter subscription, we do not use it to build a profile of you, and our newsletter form is configured not to record one at all. We do not run UTM or campaign tracking on this site.

How We Use Your Information

  • To Provide Services: To deliver the newsletters, community access, or digital products you requested.
  • To Improve Our Tools: To understand which features are used most often.
  • Communication: To send you administrative notifications and marketing communications. You may opt-out at any time.

Third-Party Tools & Data Sharing

We do not sell your data. We utilize third-party service providers to facilitate our business operations.

  • Infrastructure: We use trusted third-party platforms for hosting, analytics, and CRM (Customer Relationship Management).
  • No Advertising or Retargeting: We do not run advertising pixels, analytics tags, or retargeting technology of any kind on this site.
  • Who Actually Receives Your Data: We have never uploaded your email address to an advertising platform to build a matched audience, and we do not do so. Payments are processed by Stripe, which receives what it needs to take a payment. Email is handled by our own installation on our own hosting. We do not sell or rent your information.

3. TERMS OF SERVICE & COMMUNITY GUIDELINES

Access and License

  • Limited License: We grant you a revocable, non-exclusive, non-transferable license to access our digital products and community for your personal, non-commercial use.
  • Developing Kits are different: A Nitwyt Developing Kit is sold to be built with, so the limit above does not apply to it. Your licence covers commercial use and client work, and you owe us no royalty on anything you build with it. What you may not do is resell, redistribute or sub-license the kit files themselves, or put the Nitwyt name or mark on what you build.
  • Intellectual Property:
    • Our Content: All code, templates, kits, audios, videos, and written content provided by the Company are the intellectual property of Tomitrader LLC. You may not resell, redistribute, or sub-license our materials.
    • Your Results: You own the specific output, results, or business outcomes you create using our tools.

Community Code of Conduct

Our Community is a professional environment. We operate a zero-tolerance policy for:

  • Harassment, hate speech, or bullying.
  • Spam or unauthorized solicitation.
  • Disruptive behavior that negatively impacts the experience of other members.

Termination: We reserve the right to terminate your access to the Community and Services immediately, without prior notice or refund, if you violate these Community Guidelines.

Subscription vs. Lifetime Access

  • “Bucket” Purchases (One-Time): Products designated as “Lifetime” or “One-Time Purchase” grant you ongoing access to the specific version of the file or content purchased.
  • No Subscriptions: We do not sell recurring memberships. Everything in our catalogue is a one-time purchase, and access does not expire because a billing cycle ended. Where a product is described as a developing kit, your licence covers the versions that come after the one you bought.

  • Live Consulting Time: Consulting packages are booked time with a person, not a download, so the 30-day guarantee above does not cover them. Where we build it together, you may cancel for a full refund at any point before your first session. Once that session has taken place the time has been spent. Where we build it for you, you have longer: you may cancel for a full refund at any point up to the end of your second session, because by then you have seen the work being made and can judge it.
  • Nothing to Cancel: Because we do not bill on a recurring basis, there is no subscription to cancel and no renewal to stop. The 30-day window above is the whole of it.
